Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of shop.kingdomofgnome.com (the “Site”), including any purchase of products or services offered through the Site, and any future websites, subdomains, mobile applications, or related services operated by us (collectively, the “Services”).

The Services are doing business as Kingdom of Gnome, along with affiliated brands and projects including but not limited to Gnomefolk Naturals and Gnome King (collectively, “we,” “us,” “our,” or the “Company”). We may update the legal operating entity name in these Terms if our business structure changes.

By accessing or using the Services, creating an account, placing an order, enrolling in a subscription, or otherwise interacting with us, you agree to these Terms, our Privacy Policy [Link to Privacy Policy], and any additional policies referenced in these Terms (collectively, the “Agreement”). If you do not agree, do not use the Services.

We may update these Terms at any time. Changes will be posted on this page with a revised “Last Updated” date. Continued use of the Services after changes constitutes acceptance of the updated Terms.


1) Definitions

  • “Account” means your customer account for the Services.

  • “Affiliates” means our related brands and projects that we operate or control.

  • “Company Parties” means the Company and its owners, officers, directors, employees, contractors, agents, Affiliates, and Third-Party Providers.

  • “Order” means any request to purchase Products or Services through the Services.

  • “Products” includes all goods offered through the Services, including consumables, dietary supplements, coffee, teas, wellness bundles, merchandise, apparel, accessories, digital products, music, downloadable content, and any future offerings.

  • “Services” means the Site, any mobile apps, email communications, customer portals, customer support, and related features.

  • “Subscription” means any recurring purchase plan that renews automatically until paused or canceled.

  • “Third-Party Provider” means any provider used to operate the Services or fulfill Orders, including payment processors, subscription platforms, manufacturers, fulfillment partners, dropshippers, and shipping carriers.

  • “User Content” means reviews, photos, comments, submissions, or other content you provide through the Services.


2) Privacy

Your use of the Services is governed by our Privacy Policy [Link to Privacy Policy]. By using the Services, you consent to our privacy practices as described there.


3) Eligibility and Acceptable Use

You must be at least 18 years old (or the age of majority where you live) to place an Order or enroll in a Subscription. If you are under 18, you may only use the Services with the supervision and consent of a parent or legal guardian.

You agree not to:

  • Violate any law, regulation, or these Terms

  • Use the Services for fraudulent or unauthorized purposes

  • Interfere with the security or operation of the Services

  • Attempt to gain unauthorized access to systems, data, or Accounts

  • Copy, scrape, harvest, or exploit data without permission

  • Use automated tools except as expressly permitted

  • Transmit malware or harmful code

  • Engage in phishing, spamming, or unsolicited communications

  • Submit false, misleading, defamatory, or harmful content

We may suspend or terminate access to the Services at any time for suspected misuse, without notice, to the extent permitted by law.


4) Accounts and Accuracy of Information

You agree to provide accurate, current, and complete information, and to update it promptly if it changes. You are responsible for maintaining the confidentiality of your login credentials and all activity under your Account.

We are not responsible for issues caused by incorrect or outdated information you provide, including shipping errors, delivery failures, or missed subscription changes.


5) Product Information, Availability, and Changes

We strive to provide accurate Product information, but we do not guarantee that descriptions, images, labels, colors, ingredients, specifications, or other content are complete, current, or error-free.

Products, packaging, ingredients, sourcing, serving sizes, and label formatting may change over time. We may discontinue or modify Products at any time.

All weights, measurements, and similar descriptions are approximate. Actual Product appearance may vary.


6) Orders, Acceptance, and Cancellations

Placing an Order is an offer to purchase. We may accept, reject, limit, or cancel any Order at our discretion, including for suspected fraud, listing errors, inventory constraints, fulfillment limitations, or violations of these Terms.

We may:

  • Limit quantities per person, household, or Order

  • Cancel Orders that appear to be placed by resellers or bots

  • Require additional verification

If we cancel an Order after payment, we will issue a refund to the original payment method.


7) Pricing, Taxes, and Payments

All prices are listed in U.S. dollars unless stated otherwise. Prices exclude taxes, shipping, handling, duties, and other fees unless explicitly included.

We may correct pricing or listing errors at any time. If an error affects your Order, we may cancel the Order and issue a refund.

Taxes are calculated based on your shipping address and applicable law. You are responsible for any taxes, duties, or fees associated with your Order.

Payment processing is handled by Third-Party Providers. You authorize us and our providers to charge your payment method for all amounts due, including recurring subscription charges where applicable. We do not store full payment card details.


8) Shipping, Delivery, Risk of Loss, and Address Issues

Shipping times are estimates and not guaranteed. Delays may occur due to carriers, fulfillment partners, weather, customs, or events beyond our control.

To the fullest extent permitted by law, risk of loss and title pass to you upon handoff to the carrier.

You are responsible for providing a complete and accurate shipping address. If an Order is returned or undeliverable due to an incorrect address, refusal, or failure to claim delivery, you may be responsible for reshipment and related costs, where permitted by law.

We are not responsible for:

  • Carrier delays or errors

  • Stolen packages after delivery confirmation

  • Customs delays, duties, or fees for international Orders if offered

  • Delivery issues caused by incomplete, incorrect, or unclaimed address information


9) Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return and Refund Policy [Link to Return Policy], which is incorporated into these Terms.

Because many Products are consumable or personal-use items, returns and exchanges may be limited or not permitted due to health and safety reasons, except where required by law.

Refunds, if approved, are issued to the original payment method. Shipping fees are non-refundable unless required by law or due to our error.

We may require proof such as photos for damaged, defective, or incorrect items. We may refuse requests for suspected abuse or repeated claims.


10) Subscriptions and Recurring Billing

If you enroll in a Subscription, you authorize recurring charges to your payment method according to the frequency and price shown at checkout or in your customer portal, until you pause or cancel.

Key terms:

  • Billing occurs automatically on the schedule shown in your customer portal

  • You can manage, skip, pause, or cancel online through the customer portal prior to the next scheduled charge

  • Changes made after a billing event may apply to the following cycle

  • Payment failures may result in delayed shipments or subscription suspension

  • We may change subscription pricing, product availability, or shipping terms with notice as required by law

Cancellation: You may cancel a Subscription at any time through the customer portal. If you cannot access the portal, contact support through our contact form, and we will assist. To avoid being charged for the next shipment, cancellations or changes must be made before your next scheduled billing event. A processing window may apply, which will be shown in your portal.


11) Bundles and Multi-Item Systems

Some Products are sold as bundles or multi-item systems. Bundle contents are listed on the product page. Components may ship separately, ship in multiple packages, or ship at different times depending on fulfillment logistics.

If a bundle component becomes unavailable, we may substitute an item of equal or greater value when reasonable. If a substitution would be materially different, we may provide an option to cancel the affected shipment prior to billing when practicable.


12) Digital Products, Downloads, and License Terms

Some Products may be delivered digitally, including music, downloads, and other digital content.

Unless otherwise stated, digital purchases grant you a personal, non-exclusive, non-transferable license for your own personal use. You may not resell, redistribute, publicly perform, publicly display, or otherwise exploit digital content except where expressly permitted in writing.

Digital purchases are final once delivered, except where required by law or stated in our Return and Refund Policy.


13) Health, Wellness, and Consumable Product Disclaimers

Our Products are intended for general wellness and personal use only. They are not intended to diagnose, treat, cure, or prevent any disease.

Information on the Services is for general informational purposes only and is not medical advice. You should consult a qualified healthcare professional before using any supplement or consumable product, especially if you are pregnant, nursing, taking medications, have a medical condition, or are under medical supervision.

You are responsible for:

  • Reviewing product labels, ingredients, allergen statements, directions, and warnings upon receipt

  • Using Products only as directed

  • Storing and handling Products properly

  • Discontinuing use if you experience an adverse reaction

If you have allergies, sensitivities, or dietary restrictions, do not rely solely on site content. Always review the product label.


14) Assumption of Risk and Proper Use

By purchasing or using any Product, you acknowledge and agree that:

  • You assume risks associated with use, handling, storage, and consumption

  • You are responsible for determining whether Products are appropriate for you

  • You will follow all label directions and warnings

To the fullest extent permitted by law, Company Parties are not responsible for adverse effects arising from misuse, overuse, failure to follow directions, or use contrary to warnings.


15) Third-Party Manufacturing, Fulfillment, and Recalls

Many Products are manufactured, packaged, stored, and shipped by Third-Party Providers. We select partners we believe to be reputable, but we do not control every aspect of third-party operations.

We do not warrant that third-party manufacturing, fulfillment, or shipping will be uninterrupted, error-free, or free from delay.

If a Product is subject to a recall or safety notice, we may notify affected customers using available contact information. You agree to cooperate with reasonable recall instructions, including returning or disposing of affected Products where applicable.


16) Promotions, Discounts, and Gift Cards

Promotions, discount codes, and offers may have eligibility rules, expiration dates, and limitations. We may modify or end promotions at any time.

Gift cards, if offered, are subject to separate terms and may be non-refundable where permitted by law.


17) Intellectual Property

All content on the Services, including trademarks, logos, designs, images, text, audio, video, and software, is owned by us or licensed to us and is protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.


18) User Content and Reviews

If you submit User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, distribute, and adapt that content for business purposes, including marketing, unless prohibited by law.

You represent that you have rights to submit the User Content and that it does not violate laws or third-party rights. We may remove User Content at our discretion.


19) Third-Party Links and Services

The Services may contain links to or integrations with third-party websites or services. We do not endorse or control third parties and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.


20) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and Products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free

  • Products will meet your expectations

  • Any outcome or result will be achieved

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.


21) Limitation of Liability

To the fullest extent permitted by law, Company Parties shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to the Services or Products.

To the fullest extent permitted by law, the total liability of Company Parties for any claim shall not exceed the greater of $100 or the total amount you paid to us for the Product or Subscription shipment that gave rise to the claim in the 12 months preceding the claim.

Some jurisdictions do not allow limitations of liability, so some limitations may not apply to you.


22) Indemnification

You agree to indemnify, defend, and hold harmless Company Parties from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Services or Products

  • Your violation of these Terms or any applicable law

  • Your violation of third-party rights

  • User Content you submit

  • Fraud or misrepresentation

This obligation survives termination.


23) Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute without first contacting us to attempt resolution, we may suspend your Account and active Subscriptions.

We may provide order details, delivery confirmation, tracking information, and related records to payment providers to contest disputes.


24) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, supply chain disruptions, carrier interruptions, labor disputes, war, terrorism, civil unrest, pandemics, or government actions.


25) Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.


26) Dispute Resolution, Arbitration, and Class Action Waiver

26.1 Informal Resolution First

Before initiating a formal claim, you agree to contact us through our contact form and attempt to resolve the dispute informally for at least 30 days.

26.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, Products, or Subscriptions will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or a comparable provider.

Arbitration may be conducted by video, telephone, or written submissions where permitted by the rules. If an in-person hearing is required, the location will be determined under the applicable consumer rules, including consideration of your residence.

26.3 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement or misuse of confidential information.

26.4 Class Action Waiver

You agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding


27) Venue for Court Actions

For disputes that are properly brought in court under Section 26.3, you agree to exclusive venue in the state or federal courts located in Whatcom County, Washington, and you consent to personal jurisdiction there, except where prohibited by law.


28) Miscellaneous

  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.

  • No Waiver: Failure to enforce a provision is not a waiver.

  • Assignment: We may assign these Terms without notice. You may not assign without our prior written consent.

  • Entire Agreement: These Terms and referenced policies form the entire agreement between you and us.

  • Electronic Communications: You consent to receive communications electronically.

  • Survival: Provisions that should survive termination will survive, including liability limits, indemnification, and dispute provisions.

  • No Third-Party Beneficiaries: These Terms do not create rights for third parties.
